"Crimes & Contracts"
CIVIL REMEDIES for CRIMINAL CONDUCT
The line between outright "criminal" fraud is clever, but legal manipulation constituting "civil" fraud is often indistinguishable to the non-lawyer. In fact, many "civil" lawyers, who lack a criminal-practice background, may not readily recognize a clever "civil" fraud or civil theft.
Frequently, criminal statutes are violated and the victims of these crimes have been financially damaged, or even wiped out. Persons who never had a legal problem in their lives, as well as small businesses and multi-national, billion-dollar corporations suddenly find themselves in desperate straights as victims of a complex scheme to defraud.
The inescapable stories persist: Enron, Madoff, Rothstein. It happens every day, doesn't it?
MONEY DAMAGES for CRIMINAL CONDUCT
It does happen every day, and not just to individuals. Owners of small businesses and even major corporations are lured into seemingly advantageous relationships, binding agreements, and contractual obligations, either written or oral, by unscrupulous master-manipulators armed with nothing more than a grab-bag of false promises and fraudulent representations.
Two months earlier it all seemed a tower of propriety and prosperity. Then ... the bottom falls out.
Then, the inevitable question arises: "Who are you going to call?"
Or, worse still, the master-manipulator claims you or your business has failed to meet the obligations imposed under the terms and provisions of the contract, and sues you. It does happen every day, and not just to individuals. Suddenly, the investment capital ... wiped out .... perhaps the investor's life savings ... gone ... and you don't know which way to turn.
Now, the same question: "Who are you going to call?"
The police tell such victims "It's a civil matter, see a lawyer." But, many civil lawyers, unschooled in the available statutes say. "Go to the police" or more difficult yet, "Report it to the FBI".
Either way, you want your money back and you know it isn't going to happen until somebody - your lawyer - turns up the heat on the people who treated your money like it was nothing more than digits on a score card, except now, you're showing "zero" on the board.
"Fraud in the Inducement"
Yet, even that's not the worst scenario: Worse still: You-yourself have been sued on the contract that you were fraudulently induced to sign.
The only reason you signed or orally agreed in the first place was because your new contractual "partner" made a lot promises he never intended to keep, and knew he wouldn't, right from the opening bell.
Attorneys who were never career prosecutors are often unfamiliar with the available statutes, both Federal and State, which provide civil remedies and money damages to such victims. Civil lawyers say: "See the police" or "See the FBI".
That could be correct; but, it is often easier said than done. Because on the flip side, criminal lawyers are sometimes a bit too quick to sing the same tune: "Oh, that's a civil matter. You need to see a civil attorney."
The highest possible priority will be given to the AVOIDANCE of costly litigation.
